Kelly is a Director based in Edinburgh and a qualified Solicitor in Scotland, England and Wales, representing clients across all four corners of the UK. She is also a Notary Public (FCO approved) and holds prestigious membership with the WS Society as a Writer to His Majesty’s Signet ‘WS’. Prior to relocating to Scotland in 2016, she was based in Fragomen’s London office for more than five years.

Kelly leads the firm’s UK Energy Sector Group, as well as the UK Space Industry Group. With her experience and interest in these sectors, she’s adept to advising on the nuances associated with issues unique to working within UK Territorial Waters (UKTW), continental shelf (offshore) workers and seafarers in the energy, oil & gas and maritime sectors. In addition, she works closely with clients to assess workforce planning, as well as assessing appetites for commercial decisions whilst balancing compliance risk.

Kelly was personally approached to become a member of the Scottish Parliament’s Cross-party group on Space and is an active contributor and speaker at industry events. Given the UK’s ambitious net zero targets, she also advises on the relevancy of Green Skills, specific to these rapidly growing sectors.

Kelly is also responsible for coordinating and managing immigration programs on behalf of clients globally. She often coordinates coverage for her clients globally and delivers strategic legal and tactical advice as well as advisory services.

With more than 10 years of experience at Fragomen, she has a wealth of noteworthy experience, covering the full immigration spectrum including:

Sponsored routes: Skilled workers, temporary workers (Global Business Mobility);

  • Non-sponsored routes: Ancestry, Investor, Business Development and Talent routes, British Nationals Overseas, EUSS, Youth Mobility Schemes, Students and Graduates and Family Members of migrants;
  • Citizenship including registration of children and naturalization of adults as British Citizens;
  • Permanent residence (Indefinite Leave to Remain) under different pathways;
  • Sponsor licences including Expansion Worker.

Kelly holds a Master of Laws (LL.M) in Advanced Legal Practice (employment law) which she applies to her immigration practice when clients encounter challenges associated with notice periods, TUPE and impacts of corporate restructurings.

Kelly is part of Fragomen's Corporate Social Responsibility and Pro Bono teams and in 2024 she was recognized by the Law Society of England and Wales in their pro-bono recognition list. She is also a student mentor for her alma mater and actively supports the development of others at Fragomen having trained and qualified with the firm.

Experience

Conducted comparative analysis for clients to determine quickest routes possible into EU Member States for their assignees.

Frequent speaker at internal and external events, including town halls, seminars and conferences.

Proficient in the EU ICT Enforcement Directive and Posted Worker requirements.

Advised extensively on Business Travel within EMEA, specifically genuine travel as a visitor versus need for work authorisation and Posted Worker requirements.

Coordinates firm’s largest client graduate schemes. Also experienced at providing advice on Milkround and H1B Contingency planning.

Acted on behalf of VIP clients (including actors in the film & TV industry) maintaining discretion and candour given sensitive nature of applications.

Assisted clients who had been issued international arrest warrants by liaising with criminal defence and extradition lawyers in connection with proposed travel and advising on implications/risk of travel.

Successfully assisted clients with complex and discretionary applications due to criminal convictions/adverse immigration history following PTSD diagnosis in extremely compelling and compassionate circumstances.

As part of Training contract, completed seats in Compliance & Sponsorship, Foreign & Consular Practice, assisted Partners, as well as a secondment to the International Family Law Group (IFLG).
