Nam-Giao is a Senior Associate at Fragomen’s Irvine office, where she provides clients with tailored immigration solutions, including preparing and filing family, investor and employment-based nonimmigrant and immigrant visa petitions.

Nam-Giao has extensive experience representing investors in the preparation and filing of EB-5 petitions and collaborating with regional centers, developers, agents, securities attorneys, economists and business plan writers involved in the EB-5 immigration process. She also has experience representing clients at adjustment of status and naturalization interviews and is well-versed in immigration litigation, having successfully filed dozens of mandamus actions in federal district courts across the country to compel decisions on long-pending cases.

Prior to joining Fragomen, Nam-Giao served as an attorney at boutique immigration law firms in the San Francisco Bay area. While in law school, Nam-Giao interned for the U.S. Department of Labor, where she reviewed U-visa applications for certification and supported the agency’s litigation strategies by preparing research memoranda and court filings. She also served as a judicial clerk for the Ninth Circuit Court of Appeals, where she drafted opinions and presented cases before three-judge panels. As a student attorney, Nam-Giao assisted survivors of human trafficking and contributed to Massachusetts’ first-ever guide for attorneys on representing victims of human trafficking.

Nam-Giao has provided pro bono immigration services with the Volunteer Lawyers Project in Boston, Massachusetts, the Vietnamese American Bar Association of Northern California in San Jose, California and the Public Law Center in Orange County, California.

Experience

Prepared and filed hundreds of approved EB-5 petitions for foreign investors in direct and regional center projects and I-924 applications for regional center designation.

Served as co-counsel for a mandamus action filed in the U.S. District Court for the Northern District of California, resulting in a favorable finding that USCIS’ two-year delay in processing the plaintiff’s EB-5 immigration petition was unreasonable.

Drafted pleadings, motions, opposition briefs and legal memoranda for dozens of immigration litigation cases in district courts throughout the country.
