El COVID-19 ha paralizado al mundo, millones de personas permanecen en sus hogares en confinamiento absoluto, los países han cerrado sus fronteras y la economía global se encuentra detenida. De hecho, las proyecciones recientes del Fondo Monetario Internacional resultan alarmantes, y apuntan a una caída del -3% en el crecimiento mundial. 

Como medida de control para evitar la propagación masiva del virus, las restricciones de carácter migratorio han sido una de las medidas para evitar el contagio y que más impacto tienen en la reducción del mismo, pero que a su vez ha perjudicado más a la economía. No obstante, la recuperación económica de los países y el desarrollo del comercio internacional dependerán, considerablemente, de la movilidad migratoria y la apertura de fronteras. El presente artículo tendrá como propósito analizar el rol de la inmigración con fines laborales o de negocios, de cara a la reactivación económica inminente alrededor del mundo. 

En la actualidad la movilidad de personal con fines laborales o de negocios, representa una gran parte del número de migrantes a nivel global. En efecto, según estudios de la Organización para la Cooperación y el Desarrollo Económico la migración laboral a nivel mundial constituye una gran parte de la inmigración total en el mundo; por ejemplo, en el 2015 el número de trabajadores migrantes fue de aproximadamente 150.3 millones de conformidad con la OIT (Organización Internacional del Trabajo). Esta situación plantea un reto mayúsculo para los gobiernos pues por un lado, estos deberán promover la reactivación económica que depende, en gran medida, de los negocios transfronterizos, y por otro, controlar tanto sus fronteras como la propagación del COVID-19.

En este sentido, posiblemente la movilidad de personas, con la finalidad de procurar negocios o mano de obra calificada para el desarrollo y la reactivación de las diferentes industrias, tendrá controles migratorios rigurosos que apuntarán a la justificación real de la necesidad de mano de obra extranjera. Adicionalmente, es posible que estos procesos migratorios involucren la verificación de cobertura en salud del extranjero con el fin de salvaguardar los sistemas de salud locales, entre otros, pero que en todo caso tendrán como objetivo evitar el ingreso de personas que puedan acarrear un riesgo adicional, no solo para la salud de los habitantes de un país, sino para la fuerza laboral y las tasas de desempleo locales.

Ahora bien, a pesar de la rigurosidad que podría evidenciarse en desarrollo de los procesos migratorios en los próximos meses, este puede ser un momento clave para la negociación y firma de tratados y acuerdos de cooperación entre los Estados como una medida para incentivar el comercio entre los países. Esto resultará en medidas beneficiosas y prerrogativas para las partes, entre las cuales se podría encontrar la migración y movilidad de personal de negocios o con fines laborales. Y, es precisamente aquí donde la globalización es a todas luces una oportunidad y se consolida como eje esencial de la economía global, pues el trabajo conjunto de los gobiernos, con empresas locales e internacionales, será fundamental para restablecer y reactivar el tejido económico global. 

Nuestro rol como asesores es prepararnos para nuevas restricciones en todas las jurisdicciones y estar a la vanguardia en relación con las tendencias y políticas que se implementen en cada país, pues tenemos la obligación de comprender los procesos migratorios y plantear estrategias eficientes para nuestros clientes. Por su parte, las compañías deberán prepararse para experimentar cambios importantes en los procesos de movilidad, pues si bien la movilidad global jugará un papel esencial en la reactivación económica, será necesaria la adaptación a procesos migratorios más extensos y complejos. 

Así las cosas, resultará fundamental que las políticas de movilidad global para los empleados de las compañías se encuentren fortalecidas. Lo anterior, ya que a pesar de que una de las aristas principales para la reactivación económica entre los países será el movimiento de trabajadores como parte de la estrategia para estimular y promover el intercambio de bienes y servicios a nivel global, la tendencia en la mayoría de los países posiblemente representará un proceso migratorio riguroso pero ineludible para lograr la recuperación de la economía mundial. 

En conclusión, será prioridad comprender la finalidad de las medidas y políticas de carácter migratorio, de manera que la movilidad con fines laborales y de negocios se lleve a cabo mediante procedimientos adecuados que permitan el traslado internacional de personas de manera eficiente, pues tanto los gobiernos como las industrias deberán ajustarse a las nuevas necesidades globales de controlar el contagio del COVID-19 y a su vez reactivar la economía.
