The situation
New rules relating to posted workers in France went into effect on July 1, 2019. In order to incorporate the changes, the government is updating the online system used to submit posted worker notifications.
A closer look
In particular, the website updates relate to the following new rules:
- Additional information requested. The foreign employer will need to provide new information on the online posted worker notification form, such as the European Value Added Tax number of the co-contracting party, the employee’s gender, and the employee’s hourly salary rate during the assignment in France.
- Relaxed rules. Employers will be able to designate a representative in France (part of the posted worker regulations) on the new website, replacing the requirement of a hard copy submission of this document.
Impact for employers
As part of the update, the website will be unavailable on July 10, 2019. Employers will be unable to submit posted worker notifications online on this date and should plan to submit notifications before or after this date.
Once the website is updated, employers will be asked to provide new information on the posted worker notification form and will be able to designate a representative in France on the website rather than retain a hard copy.
All notifications already submitted on the old website will be transferred to the new version and employers do not need to resubmit notifications.
Background
The new rules and related website updates are part of a broader government policy to simplify the process for submission of posted worker notifications so that foreign companies can submit their notifications as quickly and precisely as possible.
Looking ahead
The government is expected to announce when the update process is complete and any new procedures employers will need to undertake to use the system, if any.
Additionally, another decree related to this law is expected to be implemented by the end of 2019 that should simplify employers’ obligations to submit posted worker notifications and that should relax rules related to posted worker declarations for companies regularly seconding employees to France.
