今年第一四半期は、日系企業に大きな影響を与える目立った移民施策の発表はありませんでしたが、第二四半期に入り企業のH-1Bビザ申請やPERM申請に大きな影響を与える相場賃金統計の規則変更案が提出されました。この変更案が通れば、賃金統計上の給与額が上がるため、H-1BビザやPERM申請では会社がオファーする給与額では不十分とみなされ、給与額を挙げなければ申請ができない状況が生まれる可能性があります。外国人に対する海外渡航における注意点をまとめた案内を含め、詳細はダイジェストをご参照ください。

1. 労働省、PERMおよびH-1B最低賃金引き上げ規則を提案

問題

労働省は、H-1B、E-3、H-1B1の非移民ビザ申請およびPERM労働認証プログラムの賃金引き上げを、現行賃金制度の改訂を通じて行っていることを、連邦官報に掲載される規則制定案通知が明らかにしています。 この提案規則は、第一次トランプ政権で試みた賃金引き上げと類似する取り組みを復活させており、当時の試みは裁判で争われ最終的にバイデン政権によって放棄されました。 現行賃金引き上げを目指す新規則は、トランプ政権がH-1B労働者の雇用に伴う賃金引き上げとコスト増加を推進する他の取り組みを受けて、特定のH-1B申請に対し10万ドルの手数料を課すことや、労働省の4段階の優位賃金制度に基づく最高賃金の受益者を優遇する年次のH-1B発給枠申請の抽選における新たな加重選考プロセスの導入に続くものです。 労働省は提案を発表した3月27日から60日間、一般からの意見を公募しています。この提案は、規制が連邦の規則制定プロセスを通過してはじめて最終決定されます。

 

詳細

労働省は、労働統計局(Bureau of Labor Statistics - BLS)の職業雇用・賃金統計(Occupational Employment and Wage Statistics - OEWS) データを用いて、幅広い職業の現行賃金を算出しています。現在の賃金率とは、特定の職業に対し、意図された雇用地域における同様の雇用者に支払われる平均賃金と定義されます。OEWSの賃金は、エントリーレベルから経験者までのスキルの範囲を表す4つの階層または賃金レベルに細分されています。 新規則の下では、外国人労働者の4つの技能・経験レベルすべてにおいて、OEWSの最低賃金が大幅に引き上げられます。例えば、現行の規則では、スキルレベルI (エントリーレベル)の最低賃金は、職業の平均賃金の下から17%の水準に設定されています。しかし、新規則が施行されると、エントリーレベルの最低賃金は現在スキルレベルIIの賃金として設定されている下から34%の水準に引き上げられます。 以下のグラフは、今回の提案で4つのOEWS賃金水準がどのように変化するかを示しています。

提案された改訂パーセンタイルは、第一次トランプ政権終わりに発表された最終賃金規則の内容とほぼ同じであり、当時この規則は裁判で争われ、最終的に施行されませんでした。

提案された規則は、政府のOEWS給与調査データに基づくH-1B、H-1B1、E-3労働条件申請(Labor Condition Application - LCA)およびPERM申請の最低賃金を大幅に引き上げますが、提案規則は引き続き雇用主が労働省の賃金パーセンタイルの対象外の別の賃金統計を使用することを許しています。

新たに求められる賃金水準は、規則施行日までに労働省が審査中の賃金決定(Prevailing Wage Determination)申請および新たに提出する賃金決定申請および施行日以降に提出されたLCAにのみ適用されます。新しいパーセンタイルは、規則施行以前に発行または承認された現行賃金決定、PERM、またはLCAには適用されません。

提案規則の前文で、労働省は新たな高賃金最低基準の実施を2年延期することを検討したが、既存の認定や(労働省の言葉で言えば)「更新」には適用されず、新規LCAおよびPERM申請にのみ適用されるため、延期はしなかったと述べました。LCA、PERM、そして現在の賃金決定は更新不可であるため、労働省が言う「更新」が何を意味するのかは明確ではありません。それでも、申請の基となったLCAが規則の施行日以降に提出された場合、H-1B、H-1B1、E-3の延長は新規則の対象となるようです。

 

提案された規制の今後の展望

DOLは提案が連邦官報に掲載されてから60日間、規制に関する一般からの意見を受け付けます。意見募集期間終了後、労働省はその意見を考慮しなければなりません。この意見を考慮する期間には期限はありませんが、通常一般意見の募集期間と同じかそれに近い期間検討します。ただし、検討期間をもっと短くすることも可能です。審査が完了すると、規則は最終決定され、通常は30日から60日以内に連邦官報に掲載されます。規則が確定すれば、法的な異議申し立てが可能です。

このような規則に対する企業からの意見は、この規則が米国企業のグローバル人材獲得競争での立場に与える影響を政府に知らせるために極めて重要です。コメントを提出を希望する場合は、弊所の弁護士または弊所の政府戦略・コンプライアンスグループにご連絡ください。

2.         外国籍の方々の夏の海外渡航に伴う注意点

概要

      • 現在の移民政策や慣行が厳格化する中で、海外旅行を計画する外国人はリスクや要件を慎重に検討してください。
      • 渡航を予定する方は、出発前に米国再入国に必要なすべての書類を揃えているか確認してください。
      • 一部の外国人は海外渡航を決める前に、移民法の専門家へ相談する必要があるかもしれません。
      • 海外でビザを申請する必要がある人は、米国大使館で追加審査の対象となったりビザ発給が遅れる可能性があることに備えてください。
      • アメリカ合衆国への再入国時には、入国地で厳格なを審査受けることを想定してください。

3. F-1ビザを持つ留学生の海外渡航に関する注意点

概要

      1. F-1ビザの留学生で、任意実習訓練(Optional Practical Training ‐OPT)を申請中または現在OPTで勤務中、或いは今年のH-1Bビザへ資格変更を申請を行う場合は、海外旅行のリスクと要件をしっかり理解してください。
      2. 現在の状況では、留学生は大変厳しい審査に直面しており、それが学生資格、資格変更の可能、海外旅行後の米国再入国に影響を及ぼす可能性があります。
      3. H-1Bへの資格変更を希望する外国人は、申請から承認までアメリカ国内に留まらなければなりません。これにより、新たな大統領宣言である10万ドルのH-1B手数料がの対象になることを避けることができます。
      4. 米国大使館や受け入れ国の状況が予測不能であることは、海外渡航には常にリスクであり、ビザ申請や米国への再入国を遅らせる可能性があります。

 

問題

学位取得後のOPTを申請または現在OPTで働くF-1ビザの学生、またはH-1B発給枠申請や在留資格の変更申請をしている場合、国際旅行の要件とリスクを認識しておく必要があります。これは、今も大学や大学院で就学中、60日間の猶予期間中、STEM延長を含むOPT期間中、または「キャップギャップ」 ‐ 就学やOPTの終了から、H-1B資格変更申請が有効となる日までの期間又は27年4月1日迄のどちらか早い方 ‐ に属している学生に当てはまります。

また、米国政府による学生ビザ申請者および留学生に対する厳しい監視、2025年9月から施行された特定のH-1B申請に適用される10万ドルの新たな手数料、そして約40か国の国民に対するF-1ビザ発給禁止など、F-1ビザ保持者の渡航に関する考慮事項が幾つもあります。さらに、中国人や香港在住者は、学生ビザ申請が近年よりもさらに厳しい審査を受ける可能性があることに注意してください。

学生ビザ申請者は、2025年6月以降、国務省がすべてのF、J、Mビザ申請者のオンライン上の活動を厳しく監視し、ソーシャルメディアアカウントの包括的なレビューも行っていることを忘れないでください。この審査を円滑にするため、F、J、Mビザ申請者はソーシャルメディアアカウントを「公開」するよう指示されています。(これは、一連の審査強化の一環と1つとして実施されており、この施策についてはこのクライアントアラートで詳細を確認できます ここです。)

また、米国税関・国境警備局(CBP)が、現役および元学生を含むすべての外国人に対して厳重な審査を行っているという逸話的な報告もあります。
