
The situation
The Ministry of Labor expects to launch an online system for filing work contract registrations, a mandatory step in the Resident Work Visa application process, in the upcoming months.
Work contract registration application process
The steps for the new online process will be as follows:

Upload the signed work contract by both parties and sworn declaration signed by the company’s legal representative to the online system;

Submit payment online; and
-
Immediate issuance of approval by the Ministry of Labor which is used to file the visa application.
Peruvian companies should be aware that the approved work contract registration can be annulled if information in the documents is not accurate. Labor authorities (Sunafil or Ministry of Labor) that conduct local company audits can request additional documents at their discretion.
Impact

The overall processing time for the approval of the work contract will be reduced, allowing the foreign national to commence the Resident Worker Visa application step sooner.

As there are fewer documentary requirements, time required to gather these documents will significantly decrease.
Looking ahead
Foreign nationals and employers should expect that it may take a few months for the new online system to be fully operational. Fragomen will monitor the situation and report on any issues that arise.
