Le 20 janvier 2025, le président a entamé son deuxième mandat en émettant des décrets présidentiels (« executive orders ») qui ont profondément remodelé le paysage de l’immigration. Sous la nouvelle administration, plusieurs agences d’immigration ont annoncé des changements de politique, affectant notamment les rendez-vous pour les visas dans les consulats américains. Cet article examine ces changements et propose des recommandations pour y faire face.

Changements récents en matière d’immigration affectant les rendez-vous pour les visas:

      • Renforcement des contrôles: Le 20 janvier, le président a signé un décret exigeant le contrôle et le filtrage les plus rigoureux possibles pour les ressortissants étrangers demandant l’admission aux États-Unis. Le décret a également demandé aux agences gouvernementales et d’immigration de soumettre un rapport identifiant les pays pouvant faire l’objet d’une suspension partielle ou totale de l’admission de leurs ressortissants. Ce décret rappelle la mesure de « contrôle extrême » (« extreme vetting ») mise en place en 2017.
      • Restriction de l’exemption d’entretien pour les visas non-immigrants: Le 18 février 2025, le Département d’État américain a annoncé des modifications du programme d’exemption d’entretien sur son site officiel. Ce programme permet aux demandeurs éligibles de renouveler leurs visas sans entretien dans certains consulats. Auparavant, les demandeurs pouvaient être éligibles si leurs visas dans la même catégorie avait expiré dans les 48 derniers mois. Selon les nouvelles règles, seuls ceux dont le visa précédent est encore valide ou a expiré depuis moins de 12 mois peuvent bénéficier de cette exemption, sous certaines conditions. Ceux qui ne remplissent pas ces critères doivent prendre un rendez-vous en personne.

D’après cette mise à jour du Département d’État, les agents consulaires ont le pouvoir discrétionnaire d’accorder l’exemption d’entretien aux catégories suivantes, conformément à l’article 222(h) de la loi de l’immigration et la nationalité :

      • Demandeurs classifiables sous les symboles de visa A-1, A-2, C-3 (sauf les employés de maison ou employés personnels d’officiels accrédités), G-1, G-2, G-3, G-4, NATO-1 à NATO-6, ou TECRO E-1.
      • Demandeurs de visas diplomatiques ou officiels.
      • Demandeurs ayant détenu un visa dans la même catégorie, expiré depuis moins de 12 mois.

Pour être éligibles à une exemption d’entretien, les demandeurs doivent également :

      • Faire leur demande dans leur pays de nationalité ou de résidence.
      • Ne jamais avoir été refusés pour un visa (sauf si le refus a été résolu ou annulé).
      • Ne présenter aucune inéligibilité apparente ou potentielle.

Le Département d’État précise que les agents consulaires peuvent toujours exiger un entretien en personne au cas par cas ou en raison des conditions locales.

Les demandeurs de visa non-immigrant qui ne remplissent plus les critères d’exemption doivent prendre rendez-vous pour un entretien en personne au consulat américain. Certains demandeurs ayant déjà programmé un rendez-vous sans entretien ont été contraints de reprogrammer un entretien en personne. Selon le consulat concerné, cela peut entraîner des délais d’attente plus longs pour certaines catégories de visa.

      • Réduction du personnel dans les ambassades américaines: Le 12 février 2025, le président a signé un décret obligeant les employés du Département d’État à appliquer les nouvelles politiques sous peine de sanctions disciplinaires, pouvant aller jusqu’au licenciement. Cela pourrait entraîner une réduction du personnel dans les consulats américains.

Recommandations pour les rendez-vous de visas dans les consulats américains

      • Anticiper et prévoir des délais supplémentaires: Avec ces changements récents, les demandeurs de visas doivent s’attendre à des délais accrus et à des difficultés supplémentaires. Le traitement des demandes pourrait être plus long, les contrôles plus stricts et les créneaux de disponibilités pour les rendez-vous plus limités. Pour éviter les complications, il est conseillé d’entamer le processus de demande de visa plus tôt que d’habitude et de prévoir un délai supplémentaire pour le retour du passeport.
      • Suivre les mises à jour des consulats américains: Il est recommandé de consulter régulièrement les sites web des ambassades et consulats américains pour obtenir des informations détaillées sur les exigences, les procédures et le statut de fonctionnement de chaque poste. Des événements géopolitiques ou climatiques peuvent entraîner des fermetures temporaires, ce qui rend essentiel le suivi des mises à jour avant un rendez-vous.
      • S’assurer que la documentation est complète et valide: Il est crucial de préparer tous les documents nécessaires et d’anticiper des vérifications supplémentaires. Les voyageurs doivent vérifier que leur passeport est valide au moins six mois après leur date prévue de départ des États-Unis, sauf pour les ressortissants de certains pays exemptés de cette exigence. Si un visa valide est apposé sur un passeport expiré, il est possible d’entrer aux États-Unis en présentant le passeport expiré contenant le visa valide accompagné du nouveau passeport en cours de validité.
      • Considérations pour les personnes ayant plusieurs nationalités: Les demandeurs ayant plusieurs passeports doivent vérifier la disponibilité des rendez-vous dans tous les pays dont ils détiennent la citoyenneté. Certains consulats américains peuvent offrir des délais plus courts que d’autres. Il est également conseillé de consulter les politiques spécifiques de chaque consulat, car les exigences et les délais de traitement peuvent varier.
      • Gérer la procédure de traitement administratif: Certaines demandes de visa peuvent être placées en traitement administratif pour des contrôles de sécurité supplémentaires. Ce processus peut durer de quelques semaines à plusieurs mois et ne peut pas être accéléré. Les demandeurs doivent attendre au moins 180 jours après leur entretien ou la soumission de documents supplémentaires avant de demander des mises à jour sur leur dossier. Il est déconseillé de prendre des décisions importantes, comme vendre un bien immobilier ou quitter un emploi, avant l’émission du visa.

Recommandations pour les employeurs et employés aux États-Unis

Les employeurs parrainant un employé ou les travailleurs sous visa souhaitant prolonger ou modifier leur statut avec l’USCIS doivent savoir que les extensions peuvent être déposées jusqu’à six mois avant l’expiration du statut actuel. En raison des délais de traitement, il est conseillé de déposer la demande dès que possible.

Si un déplacement nécessitant un tampon de visa est prévu, il est recommandé de déposer la demande rapidement au USCIS et d’utiliser le service « premium processing » si disponible.

Il est conseillé aux demandeurs de visa de planifier une consultation avec un avocat en immigration afin d’explorer les options possibles pour accélérer le traitement de leur visa ou statut.
