- The immigration laws of Brazil provide many options to employers of foreign nationals. Brazil is a member of the MERCOSUR treaty. Requirements, processing times, employment eligibility, and benefits for accompanying family members vary by visa classification.
- A business entry authorization is required for any business activities in Brazil. Visa-waived nationals may receive the business entry authorization upon arrival, while visa nationals must obtain a Visitor Visa from a Brazilian consular post.
- Foreign nationals who intend to work in Brazil must obtain work authorization if their activities fall outside the scope of allowable visitor activities, through one of the two main categories: (1) Temporary Visas are suitable for various categories of workers, technicians, and investors. Temporary visa applicants file their visa requests at a Brazilian consular post once they have secured approval from the Ministry of Justice; (2) Residence Authorizations are suitable for various categories of workers and investors who are in Brazil and wish to change their status to a resident permit in country. Depending on the residence type, the application can be filed with the Ministry of Justice or with the Federal Police. Validity is granted based on the visa or residence type.
- The primary long-term work authorization is the Work Contract Visa, used by foreign nationals to work for a Brazilian entity under an employment contract for an initial two years. Brazil also has several other specialized visa categories for foreign nationals depending on their activities in Brazil (e.g., technical activities, training, offshore activities), nationality, or position, among other criteria.
- Brazil also offers a Digital Nomad Visa, which allows foreign nationals who are employed outside Brazil or who provide services outside Brazil (and can continue their economic activity abroad through information technology channels) to reside in and work remotely from Brazil for up to one year, without local employer sponsorship.
