About United States

  • The U.S. immigration system has two principal categories of foreign nationals: nonimmigrants who enter the U.S. temporarily; and immigrants who intend to obtain permanent residence. There are several distinct employment-based nonimmigrant and immigrant categories.
  • Most foreign nationals require a B-1 visa for business visits to the U.S. B-1 visa beneficiaries are generally admitted for a period suitable for their intended activities; generally, 180 days or less. In the current enforcement climate, the longer the stay, the higher the likelihood of scrutiny from the authorities. Certain nationalities are eligible for the Visa Waiver Program (VWP), which permits visa-free business visits of up to 90 days.
  • There are several employment-based nonimmigrant visa categories in the U.S. The most common types are the H-1B (specialty occupation), L-1 (intracompany transferee), O-1 (extraordinary ability), TN (Canadian or Mexican professional worker), E-1/E-2 (treaty traders/investors), and E-3 (Australian specialty occupation). The J-1 visa category can be employment-based but also involves a cultural exchange program.​​​
