- Malaysian immigration laws provide a range of visas and passes to non-Malaysians visiting Malaysia for business. For immigration purposes, Malaysia is divided into East Malaysia and West Malaysia. The work authorization processes for East Malaysia and West Malaysia have slightly different policies on immigration.
- Business visitors can obtain a Visit Pass (Social) (“SVP”) when they enter Malaysia either with an entry visa issued by a Malaysian consular post (visa nationals) or with only a passport (visa waiver nationals). The maximum allowable stay under an SVP issued to business visitors ranges from 14 to 90 days, depending on their citizenship. SVP extensions are rarely granted, and foreign nationals must provide compelling reasons for their extension request, such as the inability to travel out of Malaysia due to serious medical condition.
- The most common types of work authorization used by employers in Malaysia are (1) PLS@XPATS, valid for 30 days for certain foreign nationals looking to perform critical work in designated sectors, (2) the Professional Visit Pass (PVP), valid for up to 12 months for certain technical positions, and (3) the Employment Pass (EP), valid for up to five years. Employers generally must register with the Expatriate Service Division (ESD) and file PLS@XPATS, PVP, and EP applications with the Malaysia Expatriate Talent Service Centre (MYXpats Centre). For certain industries, registration may be processed by other agencies such as the Malaysia Digital Economy Corporation (MDEC).
- Greater corporate compliance is expected as Malaysian employers must attest to the accuracy and authenticity of Employment Pass applications and supporting documents. Foreign nationals cannot commence work until they are physically in possession of their work pass. Immigration authorities may also conduct background checks on visiting foreign nationals.
